Update on the Deadlines Extension for UK REACH

On 29 November 2022, the Department for the Environment, Food and Rural Affairs (Defra) published their response to the public consultation on the extension of the deadlines for registration under the UK Registration, Evaluation and Authorisation of Chemicals (REACH) Regulation which closed on 1st September 2022.

As a reminder, UK REACH is a regulation that applies to the majority of chemical substances that are manufactured in or imported into Great Britain (GB) (England, Scotland, Wales). This can be :
• A substance on its own
• A substance in a mixture, for example ink or paint
• A substance that makes up an 'article' - an object that is produced with a special shape, surface or design, for example a car, furniture or clothes.

Registrations include information on the hazards, uses and exposure of the substance. Registration information is used by HSE (the Health and Safety Executive) for regulatory purposes and by the registrants to identify appropriate risk management measures for themselves and other users down the supply chain.

As a result, Defra has announced that, in line with the feedback received from its consultation, the deadlines for registering under UK REACH should be extended by 3 years (option 1 from the public consultation). This means that the new deadlines will be October 2026, October 2028 and October 2030.

Option 1 from the public consultation refers to:
• Substances produced at 1000 tonnes or more per year or classified as CMR or classified as very toxic to aquatic organisms or present on candidate list as at 31 December 2020: deadline 27 October 2026
• Substances produced at 100 tonnes or more per year or present on candidate list as at 27 October 2023: deadline 27 October 2028
• Substances produced at 1 tonne or more per year: deadline 27 October 2030

Option 2 of its public consultation refers to the deadlines of October 2026, October 2027 and October 2028.

For your information, CTPA (the Cosmetic, Toiletry and Perfumery Association) has responded to this consultation and would also like to suggest the possibility of splitting the last tonnage band (1-100 tonnes) into two phases : 50-100 tonnes with a deadline of October 2029 and 1-50 tonnes with a deadline of October 2030.
