New approval of active chlorine as Biocidal active substance

On 26 February 2021, the European Commission published Implementing Regulations (EU) 2021/364 and (EU) 2021/365 approving, respectively, active chlorine produced by electrolysis of sodium chloride and active chlorine released from hypochlorous acid as active substances for use in biocidal products of type 1 (Human Hygiene).

Both active substances are approved subject to certain conditions and specifications:

• Active chlorine released from hypochlorous acid is approved provided that the releasing hypochlorous acid has a dry weight of at least 90.87% p/p and corresponds to the predominant species at pH 3.0-7.4.
• For active chlorine produced in situ by electrolysis of sodium chloride, it is approved provided that the sodium chloride precursor meets the purity requirements of one of several standards set out in Annex I of the 2021/364 regulation.

This regulation will enter into force 20 days after its publication in the Official Journal of the European Union. It is in accordance with the opinion of the European Chemicals Agency and of the Biocidal Products Committee of 16 June 2020.
