Coordinated enforcement project REACH-EN-FORCE-11

The Forum for Exchange of Information on Enforcement (Forum) is a network of authorities responsible for the enforcement of the REACH, CLP, PIC, POP and Biocidal Product regulations in the EU, Norway, Iceland and Liechtenstein. It is composed of one representative from each Member State, among whom a president and two vice-presidents are appointed. Other people also participate in the work of the forum, such as invited experts from the Member States.

The forum is composed of ten working groups, grouped around specific areas of enforcement. The REACH-EN-FORCE (REF) projects are among the most important enforcement projects coordinated by the forum. Several steps are necessary to set up such a project:

Forum members, ECHA and accredited stakeholder organisations submit their proposals
Potential topics for the project to focus on will be identified by the Forum working group on Prioritisation of REF projects
The project selection is done during one of the plenary meetings of the forum, which take place three times a year.

Regulation (EU) 2020/878, setting up the requirements for the compilation of safety data sheets (SDS) and amending Annex II of REACH, was published on June the 26th, 2020 in the Official Journal of the European Union. Since January 1st, 2023, the SDS of each product available on the market must comply with this regulation.

It is in this context that the forum's 11th major enforcement project (REF-11) on the verification of compliance of SDS with the requirements of the new Annex II of REACH was set up during the forum plenary meeting of June 2022. The project focuses on the substances and mixtures placed on the market in the European Economic Area (EEA), primarily on SDS sections that have been changed by Regulation (EU) 2020/878.

The whole project will take place over a period of approximately 3 years. At the end of 2022, the people working on this project aimed to develop a project manual bringing together all the necessary information for its proper execution (planning, objectives...), as well as to prepare and deliver the training for national coordinators of the project. The operational phase will take place during 2023. A reporting and evaluation phase based on the collection of results will then occur in 2024, with the aim of creating and adopting a project report.

The 2nd quarter of 2025 will be an opportunity to capitalise on the lessons learnt from this project: development of tips and tricks for inspectors, presentation of the project's results and recommendations to ECHA's accredited stakeholder organisations.
