Delegated Regulation (EU) 2023/70 published

Delegated Regulation (EU) 2023/707 amending Regulation (EC) No 1272/2008 as regards hazard classes and criteria for the classification, labelling and packaging of substances and mixtures was published in the Official Journal of the European Union on 31 March 2023. This text introduces new hazard classes and criteria into Regulation (EC) No 1272/2008 (CLP) to take full account of environmental toxicity, persistence, mobility and bioaccumulation.

Endocrine disruption for human health
- Category 1: No Symbol/pictogram - Danger - EUH380: May cause endocrine disruption in humans
- Category 2: No Symbol/pictogram - Warning - EUH381: Suspected of causing endocrine disruption in humans

• Endocrine disruptors for the environment
- Category 1: No Symbol/pictogram - Danger - EUH430: May cause endocrine disruption in the environment
- Category 2: No Symbol/pictogram - Warning - EUH431: Suspected of causing endocrine disruption in the environment

• Persistent, Bioaccumulative and Toxic or Very Persistent, Very Bioaccumulative properties
- PBT: No Symbol/pictogram - Danger - EUH440: Accumulates in the environment and living organisms including in humans
- vPvB: No Symbol/pictogram - Danger - EUH441: Strongly accumulates in the environment and living organisms including in humans

• Persistent, Mobile and Toxic or Very Persistent, Very Mobile properties
- PMT: No Symbol/pictogram - Danger - EUH450: Can cause long-lasting and diffuse contamination of water resources
- vPvM: No Symbol/pictogram - Danger - EUH451: Can cause very long-lasting and diffuse contamination of water resources

The new classifications will apply on 1 May 2025 for substances and on 1 May 2026 for mixtures. A transition period of eighteen months is provided for substances already on the market on 1 May 2025 and a transition period of two years is granted for mixtures already on the market on 1 May 2026.
